I don't think constitution allows suing Congress because it has immunity. Based on the their approval ratings you would see thousands of lawsuits everyday if it was allows to sue congress.

In that case we would have to take a number in line to sue congress because it will be big line. In other words there will be backlog to sue Congress and that backlog would be bigger than the green card backlog. :)
So it seems we cant do much against USCIS on the lawsuit besides making congress to act. why 'Politicians' are not good in any country ???
Btw, even i am EB2 - i support porting as i have seen EB3 people working with me and they are no where less in skills .... i want to file a lawsuit so that we can bring some lazy asses to justice like USCIS.

According to the following document from USCIS they issued receipts for approx 150K applications for AOS in sept. So my estimate of the total back log is
June filers 75k
July - 25k
August 200k
Sept 150k
Oct 50K
Total = 500k

Both I and my wife had LUD update on Jan 9th. We got an RFE for her (but not me), asking for evidence regarding the bona fides of marriage. It will be great if you can share your experiences on RFE with us.
Here is what USCIS specifically requested:
1. Birth certificates of children
2. Documents of joint ownership of property such as car title, house (grant deed or rental agreement), etc.
3. Joint income tax returns
4. Joint financial accounts such as bank statements
5. Spousal insurance coverage such as health insurance and life insurance
In my original application, I had submitted the marriage certificate (in English) from India. I can resubmit that.
Things that I plan to submit:
a) Marriage certificate from India.
b) Joint US income tax returns for 2006.
c) Joint bank statement.
d) Kaiser health insurance for spouse.
e) Joint credit card statements.
We do not have kids. No car title or house on joint name. No rental agreement or utility bills on joint name. We do not have life insurance.
Please let me know if these documents sound reasonable enough to convince USCIS. If there is anything else that I can provide, please do let me know.

PS: I filed I-485 in Jan 2007 under EB-1 in Nebraska Service Center. My I-140 was also approved in Jan 2007. This was not a concurrent filing. I filed I-485 after getting I-140 approved. Got finger-print, EAD, AP in April.

By virtue of your pending 485, you can stay unemployed for any length of time. But if/when CIS asks you for proof of a bonafide job offer, you should have one. Looking for a job at that time will not work.

I see that for EB2 the PD is 01 APR 2004 now. I want to know if I-485 approvals is linked to this PD date or they will work independent to these days.

I checked Rajiv Khanna's site , there is no memo to that effect.
Also , I am a client of their law firm and they didnt send/email any memo to this effect.

Congrats to all those who are lucky enough to file their I-485 by August 17. I am kind of on the unlucky side. My mandatory labor recruitment wait period of 30 days end on August 17. Wonder if anyone has any idea about I-485 availability or unavailability by september or october or may even next time this year to use up the available numbers.

Only those whose labor got approved prior to July can apply for 140/485. August Bulletin says "U" for all categories
It is hard to predict when the numbers will be available again in the future. They may open up for EB1 and for other countires except India, China, Phillipphines and Mexico.

It is safe to say notice date in Sept equal to receipting by USCIS in Sept, because at notice date, USCIS actually open your file then send receipt.
So,from , EB receipt in Sept vs. receipt in Oct = 2:1
150k in Sept. include both EB(100K) and FB (50K).
(Note: assume received FB every month 50K. 50K is a reasonable assumption,
otherwise it's no way for USCIS to approve 800K AOS a year.)
Since EB in Sept vs. Oct is 2:1, so total EB receipting in Oct. should be 50K.
Out of the 655k total, the key is lead time for FB approval, how many month?
This is the key! If we assume average FB approval takes 6 month,
then EB out of the 655k is 655K-50Kx6=355K.
Add the 50K EB in Oct. Total EB backlog is 405K.
Still the key is average FB approval time, any gurus has any idea.
I am sure the time is not 12 month. If it's 12 month,
then EB backlog= 655K-50Kx12+50K=105k. :D:D:D Which is impossible!!

What confuses me is or are you saying that calfornia service center no more process the H1-B extension. But when you go to processing time in USCIS website it still shows you that they process H1-B extension

I worked for an employer in WY 2004 as a physician and since then i resigned and moved onto another job with a new labor and I-140. However last year at the time of July isa bulletin fiasco, I asked my employer from WY in 2004 to file for an I-140 based on the previous approved labor condition in 2004 to retain that priority date under EB -2.
Employer knows I have no intent of joining them after the green card and I have my own practice , so i donot intend to join the practice.
In this scenario, if this considered a misuse of retaining priority date and how do i prove the intent and will the USCIS allow a situation like this?

Why am i not surprised at USCIS ineffcieny. I made a similar enquory through my congresswoman and they got the response that my PD is Feb 2007 and there are no VISA's available where as my I40 approval notice and PERM laber certification approval shows as Feb 16th 2006.
Stopped by again at the congreswoman office with my I140 approval notice that shows my PD as Feb 16th 2006 (EB2).
Second instance where USCIS has some knuckle heads looking at cases is when i field a SR on July12th about my I485 to which i got a response that they cannot find my approved I140 in their system and told me to call back with the receipt number. Now when i call back they refused to take my receipt number as its not been 30 days of my SR and in order for them to take my receipt number they need to open another case and can do it only after 30 days.
Absolutely no accountability! I have mailed Ombudsman with all the replies i got from USCIS and hoping that my case is adjudicated properly.

So that implies it is not required. also the correct spelling is mandatory.
The solid evidence is the number of RFEs that have been issued by USCIS if you do not have a skin test.

been in pittsburgh for 8 yrs.license renewal no problem at pittsburgh downtown office.
need letter from employer and h1,thats it.
go to a different office or talk to the suprevisor.

H-1B is approved from Oct/1/2009. Currently I should be on L-1B. As per this article, I think I can travel without jeopardizing my future status. They call it the 'Hernandez letter'. Is this true?
